These Terms and Conditions (“Terms”) govern your use of this website and the services provided by ANN ARTISTRY (“Company,” “we,” “us,” or “our”). By accessing this website or engaging our services, you agree to be bound by these Terms.


1. Services
ANN ARTISTRY provides website design, branding, marketing design, and related digital services. Services may include but are not limited to website design, website redesigns, brand identity development, visual design assets, website management, and social media content creation.
All services are provided on a project or subscription basis as outlined in individual proposals, invoices, or agreements.

2. Platform Disclaimer (Wix Studio)
Websites are designed and developed using Wix Studio or other agreed-upon platforms. While we ensure best practices in design and setup, we are not responsible for platform outages, software updates, third-party app issues, or changes made by the platform provider.


3. Project Scope & Revisions
Each project includes a defined scope outlined in your proposal or agreement.

  • Requests outside of the agreed scope may result in additional fees.

  • Revision limits are defined per package.

  • Additional revisions beyond the included amount will be billed at an hourly or flat rate.

4. Client Responsibilities
Clients agree to:

  • Provide accurate, complete, and timely content (text, images, branding assets).

  • Respond to requests for feedback within a reasonable timeframe.

  • Ensure they have legal rights to all materials provided.

Delays in communication or content delivery may affect project timelines.


5. Payment Terms

  • A non-refundable deposit (typically 50%) is required to begin all projects.

  • Remaining balances are due upon project completion or before website launch.

  • Subscription services are billed monthly unless otherwise stated.

  • Late payments may result in paused work or delayed delivery.

All payments are processed securely through approved payment methods or invoicing systems.


6. Refund Policy
Due to the custom nature of design services:

  • Deposits are non-refundable.

  • No refunds are provided for completed or partially completed work.

  • Subscription services may be canceled with written notice, effective at the next billing cycle.

7. Intellectual Property & Ownership
Upon full payment:

  • Clients receive ownership of the final approved design deliverables.

  • We retain the right to display completed work in our portfolio, website, and marketing materials unless otherwise agreed in writing.

Drafts, concepts, and unused designs remain the property of ANN ARTISTRY.


8. Website Launch & Post-Launch Support
Once a website is approved and launched:

  • Responsibility for ongoing content updates transfers to the client unless a maintenance subscription is active.

  • We are not responsible for issues caused by client edits, third-party apps, or platform updates after launch.

9. SEO, AIO & Performance Disclaimer
While best practices for SEO (Search Engine Optimization) and AIO (AI Optimization) are implemented, we do not guarantee:

  • Specific search engine rankings

  • Traffic volume

  • Conversions or sales outcomes

Results depend on many external factors beyond our control.


10. Third-Party Services
We may integrate third-party tools, apps, fonts, or plugins. We are not responsible for:

  • Changes to third-party services

  • Subscription fees associated with third-party tools

  • Service interruptions or data loss caused by third parties

11. Limitation of Liability
To the fullest extent permitted by law, ANN ARTISTRY shall not be liable for:

  • Loss of data, revenue, or business opportunities

  • Website downtime caused by hosting or platform providers

  • Indirect or consequential damages

Total liability shall not exceed the amount paid for services rendered.


12. Termination
We reserve the right to terminate services if:

  • Payments are not made

  • Communication is unresponsive

  • Terms are violated

  • Conduct is abusive or unethical

In such cases, all completed work remains billable.


13. Confidentiality
Any confidential information shared during the project will be kept private and used solely for project purposes unless disclosure is required by law.


14. Changes to Terms
We reserve the right to update these Terms at any time. Continued use of this website or services constitutes acceptance of any changes.
